1. General

The general terms and conditions of the Prosports.si online store are drawn up in accordance with the Consumer Protection Act (ZVPot), based on the recommendations of the Chamber of Commerce and Industry and international e-business codes.

The online store is managed by the company FORTRADE d.o.o., a provider of e-business services (hereinafter the "provider"). The online store Prosports.si can appear on different domains or website addresses. Upon registration in the Prosports.si system, the visitor obtains a username, which is the same as his e-mail address, and a password. The user name and password unambiguously determine and associate the user with the entered data. By registering, the visitor becomes a user and acquires the right to purchase. A user (guest) without registration can make a purchase after entering all the necessary data.

The general terms and conditions deal with the operation of Prosports.si, the user's rights and the business relationship between the provider and the customer.

2. Availibility of information

(summary of legislation)

The provider undertakes to always provide the customer with the following information:

• company identity (company name and registered office, register number),

• contact information that enables the user to communicate quickly and efficiently (e-mail, telephone number),

• essential characteristics of goods or services (including after-sales services and guarantees),

• product availability (every product or service offered on the website should be available within a reasonable time),

• conditions of product delivery or service performance (method, place and deadline of delivery),

• all prices must be clearly and unambiguously determined and it must be clearly shown whether they already include taxes and transport costs,

• method of payment and delivery,

• time validity of the offer,

• the deadline during which it is still possible to withdraw from the contract and the conditions for withdrawal, in addition also about if and how much it costs the customer to return the product,

• explanation of the complaint procedure, including all information about the contact person or customer service department.

3. Offer of articles

Due to the nature of business via the www, the offer of Prosports.si updates and changes often and quickly, and the offer depends on stocks. It may happen that due to business on different platforms, an item is resold and we will not be able to ship the item despite the order. In this case, we can agree on another, related item with the same price or refund you in full.

4. Payment and delivery methods

The provider allows the following payment methods:

• With cash upon collection in one of the Prosports.si stores

• Prepayment

• Cash on delivery (Slovenia and Croatia only)

• Payment by credit card

• Paypal

The provider issues an invoice to the customer on a durable medium, with itemized costs.

The purchase contract (order) is stored in electronic form on the provider's server and is accessible to the registered buyer at any time in his user profile (My profile).

In the case of choosing to pay by pre-invoice, if it is not settled within 14 days after receiving the order, the order will be cancelled.

Delivery/pickup is possible:

  • Personal pickup in one of the Prosports.si stores. The order is canceled if the order is not collected within 14 days after the order is in the status of goods Ready for collection.
  • Delivery by courier service. We deliver with GLS. In exceptional cases we also use other courier services, if we believe that this is better for the price or if the selected courier service does not provide all services.
  • Delivery to mailboxes is NOT possible!

5. Prices

Promotional price applies to all members of Prosports.si. A user becomes a member by registering in the Prosports.si online store. The recommended price is the price for unregistered users who want to make a purchase in the online store and are not members of Prosports.si. Registration is also possible during the purchase process.

All prices in the Prosports.si online store include 22% VAT. Prices are valid at the time of placing the order. 

PLEASE PAY ATTENTION ON VAT RATES: The prices in the basket and at the end of the order may deviate from the prices on the website!
Prices on the website include Slovenian 22% VAT. From July 1, 2021, a new regulation called OSS applies at the EU level, according to which we have to calculate the VAT of the country to which the goods are sent. Therefore, at the end of the order, the prices of the items and the postage may deviate from those indicated on the website, as the VAT rate of the country to which the item is sent is added to the price without VAT, and the final prices may be lower or higher, depending on the rate of VAT charged in the country to which items are shipped.

After placing the order, it is not possible to change the content of the order or of the final amount of the order, except in special cases determined by the provider.

The prices are valid in the case of payment with the above-mentioned payment methods, under the above-mentioned conditions.

Prosports.si will do its best to provide accurate prices, but it may still happen that the price information is incorrect. In this case, or in the event that the price of the item changes during the processing of the order, the provider will allow the buyer to withdraw from the purchase, and at the same time the provider will offer the buyer a solution that will be mutually satisfactory.

The purchase contract between the provider and the buyer is concluded the moment the buyer places an order in the online store. From this moment on, all prices and other conditions are fixed and apply to both the provider and the buyer.

Delivery costs are calculated subsequently upon completion of the order and depend on the value of the order and the country of delivery.

6. Purchase process

1. The buyer adds the products to the basket, fills in all the necessary information and submits the order.

2. You can submit an order as a guest or as a registered user.

3. After choosing the method of placing the order - as a guest or as a registered user - the user fills in the information about the delivery address and the billing address, if it is different from the delivery address.

4. In the next step, the user chooses the delivery method - personal collection in one of the branches or delivery to the address entered in point 3.

5. In the next step, the user selects and fills in the payment method. This depends on the country to which the item will be delivered.

Regardless of the method of collection and delivery of the goods, the buyer receives the order summary and payment instructions to the entered email address. When registering on the provider's website, the customer can access information about the status and content of the order.

If the cash on delivery option is selected, the buyer will receive a shipping notification as soon as the goods are shipped. It is delivered to the customer by the delivery service within three working days. Payment is made upon delivery (applies to Slovenia and Croatia).

In the case of choosing the option of payment upon collection of the goods in the store, the customer will receive a notification when the goods are ready for collection in the selected store. Payment is made upon receipt of the goods.

If you choose to pay by advance invoice, the goods are shipped when we receive the payment confirmation. The buyer is notified of the shipment of the goods to the specified email address. Order will be shipped within three working days.

In the case of payment by credit card or via Paypal, order will be shipped within three working days. The buyer is notified of the shipment of the goods to the specified email address.

Delivery time: depending on the country where the items are delivered, approximately 3-7 working days.

7. Warranty

For articles, the warranty is valid for 1 year from the date of purchase, unless otherwise stated on the warranty sheets or on the invoice. The guarantee is valid if the instructions on the guarantee sheet are followed and upon presentation of the invoice.

The warranty ceases to be valid in case of negligent handling of the products, improper use, mechanical damage or defects due to force majeure. The warranty also ceases to be valid if the product is processed or if the product is installed by an unauthorized person (in the case of installation of goods by an authorized person, the installation invoice should be issued to the buyer of the product).

Products subject to constant wear and tear are excluded from the warranty: wooden hockey sticks, composite hockey sticks, hockey sticks, wheels, bearings,...

The warranty periods are indicated on the warranty statements. Before ordering or returning, the buyer can contact the provider, who will provide up-to-date information regarding the warranty conditions for the selected products.

 8. Delivery and return of goods

Delivery in Slovenia

Goods purchased in our online store will be delivered anywhere in Slovenia at a single price. For orders over 150,00€ and products for which this is specifically stated, we will deliver the ordered goods to you free of charge. For orders under 150,00€  we charge delivery throughout Slovenia in the amount of €4.95 (prices include slovene 22% VAT), regardless of the weight, quantity or value of your order.

Most products leave our store the next working day after receiving the order (for cash on delivery). In this case, the product will be at your address within three working days of the order at the latest. In case the product is not currently in stock or deliverable, we will inform you about the delivery date by e-mail or to your phone, which you entered when registering in the online store.

The contractual partner for the delivery of shipments is GLS, but the provider reserves the right to choose another delivery service, if this will allow him to fulfill the order more efficiently, but he may not change the agreed shipping price at the time of purchase.

Delivery to Croatia

Goods purchased in our online store will be delivered to Croatia at a flat price of €9.95 (prices include slovene 22% VAT). For orders over €150.00 and products for which this is specifically stated, we will deliver the ordered goods to you free of charge. The contractual partner for the delivery of shipments to Croatia is GLS, but the provider reserves the right to choose another delivery service, if this will allow him to fulfill the order more efficiently, but he may not change the agreed shipping price at the time of purchase.

Delivery to the EU

For orders over €150.00 and products for which this is specifically stated, we will deliver the ordered goods to you free of charge. The contractual partner for the delivery of shipments within the European Union is GLS, but the provider reserves the right to choose another delivery service if this will allow him to fulfill the order more efficiently, but he may not change the agreed shipping price at the time of purchase.

Delivery price list (prices include slovene 22% VAT):

  • 9,95€ up to a total order value of 150,00€: Austria, Hungary, Italy, Croatia, Germany, Belgium, Netherlands, Luxemburg, Czech Republic, Slovakia, Denmark, Portugal, Poland, Lithuania, Latvia.
  • 12,95€ up to a total order value of 150,00€ for the following countries: Finland, Sweden, Spain, Ireland, Estonia, Romania, Bulgaria, France.
  • For orders over €150.00, shipping within EU countries is free.
Deliveries outside the EU

Would you like delivery to a country outside the EU? Please send us a list of items and quantities so that we can check the cost of postage and any other charges. You will receive a proforma invoice, when we receive the payment, we will send the items to you by DHL or other courier service.

If the customer does not accept the order, is unresponsive to calls from courier services or has provided incorrect information, we reserve the right to refund the purchase price minus the costs incurred due to the aforementioned reasons.

9. Damage to goods

If the goods were damaged during transport (the outside of the shipment), then report the shipment to the courier IMMEDIATELY. The courier will draw up a complaint record on the spot about damage to the shipment. In the case of hidden damage to the shipment, the recipient is obliged to notify the delivery service in writing within the complaint period of 8 days, counting from the date of receipt of the shipment, with the condition that we have previously established jointly with us that, in our opinion, the damage occurred exclusively at the time when the shipment was in possession of delivery.

10.The right to withdraw from the purchase

The buyer has the right to return the purchased goods within 14 days without giving any reason in accordance with the Consumer Protection Act (ZVPot) without any compensation or reason for return. The deadline begins on the day of receipt of the order from the delivery service. The buyer is obliged to bear the costs incurred when returning the item of purchase.

11. Return of goods

The buyer must notify the provider in writing of the intended return, no later than 14 days after receiving the goods, to the contact e-mail address sales@prosports.si, and return the goods within a further 30 days by personal delivery or registered courier service.

The customer may not use the items unhindered until the contract is withdrawn. The customer may inspect and test the items to the extent necessary to determine the actual condition. The customer is responsible for the reduction in the value of the goods, if the reduction is the result of conduct that is not absolutely necessary to determine the nature, properties and functioning of the goods. In the event that the customer returns an item with visible damage that occurred during the inspection of the goods at the customer's place, or if he returns an incomplete item without the knowledge and approval of the seller, the seller reserves the right to return the purchase price reduced by the amount of damage to the item.

Goods that CANNOT be returned: underwear, mouthguards and products that absorb sweat or acquire odor when used.

We recommend that the customer take a photo of the prepared package before returning it, so that in case of transport damage, compensation can be claimed from the transport service.

After receiving the return, we inspect the items and packaging and return the purchase price back to the customer. If it is determined that the returned item was not in its original packaging, was damaged, used or (partially) assembled, the customer will be refunded a percentage of the lower purchase price based on the reduced value of the item.

The refund is made via the same payment method as the item was originally paid for.

In the event that the customer ordered several of the same items in different numbers for the obvious reason of choosing the right ones for himself and returning the others, the purchase price will be refunded minus the costs (shipping costs, costs of additional work in the warehouse,...) The cost of the return postage is at customer side.

If the customer returns the item himself, we recommend shipping with tracking. We do not accept responsibility for a package sent without tracking, in case the package or contents are damaged or the package is lost. In such a case, we do not refund the purchase price and/or shipping costs.

In the event that the returned goods or the original packaging are damaged, we can refuse to return the goods.

REFUNDS: Refunds are made through the same process as the order was paid for. In the case of a refund to a credit card, you will see the refund when you have settled the accounts with the bank (monthly, weekly). When paying with Paypal, the refund is visible on your account depending on the settings you have specified on Paypal. It is possible that you need to give a manual order to transfer funds from your Paypal account to your bank account.

12. Safety

The provider uses appropriate technological and organizational means to protect the transfer and storage of personal data.

13. Protection of personal data

The provider undertakes to permanently protect all personal data of the user.

The provider will use personal data exclusively for the purposes of fulfilling the order (sending informative material, offers, invoices) and other necessary communication.

Under no circumstances will the user's data be given to unauthorized persons.

The user himself is also responsible for the protection of personal data by ensuring the security of his username and password.

14. Communication

The provider can call the customer on his contact phone number to check the data or ensure the accuracy of the delivery.

The supplier will send the order specification to the customer via e-mail. The provider will also inform the buyer about the shipped order.

The provider can also use the buyer's e-mail to send advertising messages (notifications about various actions, promotions, ...). The customer can unsubscribe from receiving e-news at any time. The provider will expressly respect the customer's wish not to receive advertising messages.

15. Disclaimer

The provider makes every effort to ensure that the information published on its pages is up-to-date and correct. Nevertheless, the characteristics of the items, the delivery time or the price can change so quickly that the provider fails to correct the information on the web pages. In such a case, the provider will inform the customer about the changes and allow him to withdraw from the order or exchange the ordered item.

Although the provider tries to provide accurate photos of the items for sale, all photos should be taken as symbolic. Photos do not guarantee product features. The provider makes every effort to ensure the correctness of prices and stock. However, there may be errors in prices or stock for various reasons, and in such a case we reserve the right to cancel orders.

16. Complaints and disputes

The provider complies with applicable consumer protection legislation. The provider makes every effort to fulfill its duty to establish an efficient system for dealing with complaints and to designate a person with whom, in case of problems, the buyer can contact by phone or e-mail. Complaints are submitted via the e-mail address office@prosports.si or sales@prosports.si. The appeal process is confidential.

Within eight working days, the provider will confirm that it has received the complaint, inform the customer how long it will take to process it and keep him informed about the progress of the procedure.

The provider is aware that an essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer not to initiate a dispute before the court. Therefore, the provider makes every effort to resolve any disputes amicably.
