1.    Delivery

A.    General

The contractual partner for the deliveries within EU is GLS, but the provider reserves the right to choose another delivery service if this will allow him to fulfill the order more efficiently, but he may not change the shipping price agreed at the time of purchase. Outside of EU we ship with DHL, UPS or Fedex.

We provide with tracking number once order is shipped. You wil lreceive tracking number to your email.

Most products leave our store the next business day after the order is received (applies to cash on delivery and credit card orders). In this case, the product will be at your address the latest within three working days after order was placedad. In case the product is not currently in stock or deliverable, we will inform you about the delivery date by e-mail or on your phone, which you entered when registering in the online store.

If the ordered items are located in different warehouses, there may be a delay in shipping, as we need to transfer the items to a single location before shipping or, if you choose to pick them up in person, to the selected branch. Before ordering, we recommend that you check the stock status by branch for each item in the "Stock by branches" tab. If orders are not shipped within 48 hours or ready for pickup within 48 hours, we will notify you via email about the approximate delivery time or when the items will be ready for pickup.

For certain products, the additional costs on the shipping price apply. For these, the shipping price is specified on the respective product below in the description in the "Details" tab or will be charged in cart during purchase. These exceptions occur due to the size of the products, their weight or because standard courier services do not allow delivery.

Delivery dates are estimated and not binding. In the vast majority of cases, delivery is carried out within the specified estimated dates, but occasionally there may be delays due to various events (holidays, heavy loads, remote locations, force majeure, etc.).

B.     Delivery in Slovenia

Goods purchased in our online store will be delivered anywhere in Slovenia at a single price. For orders over €150.00 and products for which this is specifically stated, we will deliver the ordered goods to you free of charge. For orders under €150.00, we charge delivery within the entire territory of Slovenia in the amount of €4.95 (prices include Slovenian VAT at a 22% tax rate), regardless of the weight, quantity or value of your order.

For certain products, the above provisions on the shipping price do not apply. For these, the shipping price is specified on the respective product below in the description in the "Details" tab. These exceptions occur due to the size of the products, their weight or because standard courier services do not allow delivery.

C.    Delivery to the EU

We ship to all EU countries.

For orders over €150.00 and products for which this is specifically stated, we will deliver the ordered goods to you free of charge.

D.    Deliveries outside the EU

Shipping outside the EU We ship with courier services DHL, UPS, Fedex or others, outside the EU we use air transport. Customers receive a tracking number when the package is shipped.

Orders are generally shipped within one business day, except in cases where multiple items are ordered and the items need to be obtained from other warehouses. In this case, we inform customers via email about the estimated shipping time.

The delivery time depends on the recipient's country, most often it is 3-5 business days, but it can also take longer.

CUSTOMS AND ADDITIONAL COSTS in case of ecport from EU:

Shipments outside the EU are shipped with the DAP (Delivered at place) parity, which means that:

- Tax will be deducted from the order value in the cart - you will purchase the ordered goods without paying VAT.

- All prices on the website include 22% VAT, which means that the final cost of your order will be VAT-free.

- You will pay VAT when importing the items into your country. The amount depends on the tax legislation in your country.

- In addition, the importing country may also charge customs duties on the items, which depend on the country of origin of the goods (not the country of import) and the customs tariff of the goods.

- In addition, courier services charge around €15-25 for preparing customs declarations

- In our experience, these costs together represent around 35% of the order value, but this depends on the rules in the recipient country. Therefore, we recommend that you check local customs procedures and rules before ordering.

We provide shipments with an invoice for the ordered goods, which also lists the weights of the items, customs tariff numbers and origin of the goods to enable smooth import. In addition to the above, some countries require additional evidence for certain sets of items. In this case, you can contact us at sales@prosports.si for additional assistance and guidance, we will be happy to help you prepare documentation for official procedures.

 

Is your country not on the delivery  list?

 Please send us a list of items and quantities to our email sales@prosports.si  so that we can check the cost of postage and any other charges. You will receive a proforma invoice and when we receive the payment, we will send the items to you with courier services. .

2. Damage to goods during transport

If the goods were damaged during transport (the exterior of the shipment), then report the shipment to the courier IMMEDIATELY. The courier will draw up a complaint record on the spot about damage to the shipment. In the case of hidden damage to the shipment, the recipient is obliged to notify the delivery service in writing within the complaint period of 8 days, counting from the date of receipt of the shipment, with the condition that we have previously established jointly with us that, in our opinion, the damage occurred exclusively at the time when the shipment was in possession of delivery service.

3. The right to withdraw from the purchase

The buyer has the right to return the purchased goods within 14 days without giving any reason in accordance with the Consumer Protection Act (ZVPot-1) without any compensation or reason for return. The deadline begins on the day of receipt of the order from the delivery service. The buyer is obliged to bear the costs incurred when returning the item of purchase. Returned products must be unused and in original package.

4.    Return of goods

A.    Resignation statement

The buyer must notify the seller  in writing of the intended return, no later than 14 days after receiving the goods, to the contact e-mail address sales@prosports.si, and return the goods within a further 30 days by personal delivery to one of the branches or by registered mail to company address. Fortrade d.o.o., Pod Hruševcu 50, 1360 Vrhnika, Slovenia (EU). The buyer can also use the form in LINK and send the completed form to the e-mail address sales@prosports.si.

B.     Product condition

The buyer may not use the items unhindered until withdrawal from the contract. The customer may inspect and test the items to the extent necessary to determine the actual condition. The customer is responsible for the reduction in the value of the goods, if the reduction is the result of conduct that is not absolutely necessary to determine the nature, properties and functioning of the goods. In the event that the customer returns an item with visible damage that occurred during the inspection of the goods at the customer's place, or if he returns an incomplete item without the knowledge and approval of the seller, the seller reserves the right to return the purchase price reduced by the amount of damage to the item.

Goods that CANNOT be returned: underwear, mouthguards and products that absorb sweat or acquire odor when used.

We recommend that the customer take a photo of the prepared package before returning it, so that in case of transport damage, compensation can be claimed from the transport service.

C.    Return and refund process

After receiving the return, we inspect the items and packaging and return the purchase price back to the customer. If it is determined that the returned item was not in its original packaging, was damaged, used or (partially) assembled, the customer will be refunded a percentage of the lower purchase price based on the reduced value of the item. The reduced value depends on the degree of use of the item and/or packaging and the possibility of resale as a used product. It usually varies between 15 and 50% of the sale value. In the event of serious damage that depreciates the value of the product, we reserve the right not to refund the purchase price. In such a case, the product will be discarded.

The refund is made via the same payment method as the item was originally paid for.

In the event that the customer has ordered several of the same items in different numbers for the obvious reason of choosing the right size for himself and returns the others, the purchase price will be returned minus the costs (shipping costs, costs of additional work in the warehouse, etc.). Return shipping is the responsibility of the customer.

If the customer returns the item himself, we recommend shipping with tracking. We do not accept responsibility for a package sent without tracking, in case the package or contents are damaged or the package is lost. In such a case, we do not refund the purchase price and/or shipping costs.

In the event that the returned goods or the original packaging are damaged, we can refuse to return the goods.

Refunds are made through the same process as the order was paid for. In the case of a refund to a credit card, you will see the refund when you have settled the accounts with the bank (monthly, weekly). When paying with Paypal, the refund is visible on your account depending on the settings you have specified on Paypal. It is possible that you need to give a manual order to transfer funds from your Paypal account to your bank account.

 

5.Claims

In case products you ordered, are damaged, order is incomplete or not accoring to description on our website, we kindly ask you to write to us on email sales@prosports.si. Send us photos and order number with short description of the issue. We will inspect closly your claim and try to find suitable solution. Although errors and dammages are rare, we try to keep them as few as possible, but if they do occur, we actively approach their resolution.
