1. General

The general conditions of the Prosports.si online store are drawn up in accordance with the Consumer Protection Act (ZVPot-1), based on the recommendations of the Chamber of Commerce and Industry and international codes for e-business.

The online store is managed by the company FORTRADE d.o.o., a provider of e-business services (hereinafter the "provider"). The online store Prosports.si can appear on different domains or website addresses. Upon registration in the Prosports.si system, the visitor obtains a username, which is the same as his e-mail address, and a password. The user name and password are unambiguously determined by the customer and linked to the entered data. By registering, the visitor (hereinafter "customer") becomes a user and acquires the right to purchase. A user (guest) without registration can make a purchase after entering all the necessary data.

The general business conditions deal with the operation of Prosports.si, the customer rights and the business relationship between the provider and the customer.

2. Availability of information

(summary of legislation)

The provider undertakes to always provide the customer with the following information:

  • company identity (company name and headquarters, register number, tax number),
  • contact information that enables the customer to communicate quickly and efficiently (e-mail, phone number, address),
  • essential characteristics of goods or services (including after-sales services and guarantees),
  • product availability (every product or service offered on the website should be available within a reasonable time),
  • conditions of product delivery or service performance (method, place and deadline of delivery),
  • all prices must be clearly and unambiguously determined and it must be clearly shown whether they already include taxes and transport costs,
  • method of payment and delivery,
  • time validity of the offer,
  • the deadline during which it is still possible to withdraw from the contract and the conditions for withdrawal, in addition also about if and how much it costs the customer to return the product,
  • explanation of the complaint procedure, including all information about the contact person or customer service department.

3. Offer of products

Due to the nature of business via the World Wide Web, the offer of Prosports.si. updates and changes frequently and quickly, and the offer depends on stocks. We try to maintain a realistic stock level, however, it may happen that due to business on different platforms, an item may be oversold and, despite the order of the item, we will not be able to ship it in the quantities that were ordered. In this case, we can agree on another, related item with the same price or refund you in full, but in any case, we will first consult with you about this and inform you within a reasonable time that the specific item is not available.

4. Methods of payment and delivery

The provider allows the following payment methods:

  • With cash upon collection in one of the Prosports.si stores
  • Bank transfer
  • Cash on delivery (Slovenia and Croatia only)
  • Payment by credit card
  • Paypal

The provider issues an invoice to the customer on a durable medium, with itemized costs. The customer receives the invoice via e-mail when the order is shipped.

The purchase contract (order) is stored in electronic form on the provider's server and can be accessed by the registered customer at any time in their user profile (My profile) on the website www.prosports.si

Delivery method:

Delivery/pickup is possible:

  • Personal pickup in one of the Prosports.si stores. The order is automatically canceled if the order is not collected within 14 days after the order is in the status Goods ready for collection.
  • Delivery by courier service. We deliver with GLS, except in exceptional cases we also use other courier services, if we believe that this is better for the price or if the selected courier service does not provide all services.
  • Delivery to mailboxes is NOT possible!

5. Prices

Prices on the website are published in Euros and include VAT. Prices are valid at the time of placing the order.

ATTENTION! The prices in the basket and at the end of the order may deviate from the prices on the website!

Prices on the website include Slovenian 22% VAT. From July 1, 2021, a new regulation called OSS applies at the EU level, according to which we have to calculate the VAT of the country to which the goods are delivered. Therefore, at the end of the order, the prices of the items and the postage may deviate from those indicated on the website, as the VAT rate of the country to which the item is sent is added to the price without VAT, and the final prices may be lower or higher, depending on the rate of VAT calculated in relation to the country to which items are being shipped. If the customer is registered on the site and has entered the country of delivery, the VAT and thus the final prices are also displayed according to the country entered as the country of delivery.

After placing the order, it is not possible to change the content of the order or of the final amount of the order.

The prices are valid in the case of payment with the above-mentioned payment methods, under the above-mentioned conditions.

Prosports.si will do its best to provide accurate prices, but it may still happen that the price information is incorrect due to technical or human error. In this case, or in the event that the price of the item changes during the processing of the order, the provider will allow the customer to withdraw from the purchase, and at the same time the provider will try to offer the customer a solution that will be mutually satisfactory. In the event that the published price of the item is €0.00, the provider reserves the right to cancel the order.

The purchase contract between the provider and the customer is concluded the moment the customer places an order in the online store. From this moment, all prices and other conditions are fixed and apply to both the provider and the customer, except in the cases mentioned in the previous paragraph.

Delivery costs are calculated upon completion of the order and depend on the value of the order and the country of delivery. In some cases, delivery cost is calculated individually according to the items (usually due to size/weight differences) and this is specifically indicated on the product page of the item itself and also in the basket

6. Purchase procedure

The customer adds the products to the basket, fills in all the necessary information and submits the order.

You can place an order as a guest or as a registered customer.

1. In the online store, the customer specifies the items and the quantity they wish to order.

2. In the basket, he sees the summary of the order - the items and their quantity, as well as the price of the items. You can use a discount code (voucher) in this step. In this step, the customer can change his order - remove products, increase or decrease their quantity and adds notes to the order.

3. The customer fills in the information about the delivery address and the billing address, if it is different from the delivery address, or chooses personal pickup and the branch where he will pick up the goods. Postage is calculated according to the country of delivery. In some cases, postage is calculated individually according to the items (usually due to size differences) and this is specifically indicated on the product page of the item itself and also in the basket Personal pickups are free.

4. The customer chooses the method of payment - cash on delivery, bank transfer, payment by credit card or PayPal.

5. This is followed by a review of the order and its confirmation.

6. The customer receives a confirmation email with a summary of the order.

7. The customer receives notifications by email even when the status of the order changes.

8. When the order has been shipped, the customer receives a tracking number and an invoice for the purchase by email.

The customer receives a summary of the order and payment details to the e-mail address he used to place the order, regardless of the method of collection and delivery of the goods. When logging in on the provider's website, the customer can access information about the status and content of the order, as well as an overview of past orders.

In the case of choosing the cash on delivery option, the customer will receive a shipping notification as soon as the goods are dispatched. It is delivered to the customer by the delivery service within two to five working days. Payment is made upon delivery (applies to Slovenia and Croatia only).

In the case of choosing the option of payment upon collection of the goods in the store, the customer will receive a notification when the goods are ready for collection in the selected store. Payment is made upon receipt of the goods, unless payment was made upon placing the order.

In the case of choosing payment by advance invoice, the goods are shipped when the payment is visible on the bank account. The customer is notified of the shipment of the goods to the specified email address.

In the case of payment by credit card or via Paypal, the order is shipped within three working days. The customer is notified of the shipment of the goods to the specified email address.

Delivery time: depending on the country to which the items are delivered, approximately 3-7 working days within the EU.

7. Warranty

For products for which a guarantee obligatory, the validity of the guarantee is 2 years from the date of purchase, unless otherwise stated on the guarantee sheets or on the invoice. The guarantee is valid if the instructions on the guarantee sheet are followed and upon presentation of the invoice.

The warranty ceases to be valid in case of negligent handling of the products, improper use, mechanical damage or defects due to force majeure. The warranty also ceases to be valid if the product is processed or if the product is installed by an unauthorized person (in the case of installation of goods by an authorized person, the installation invoice should be issued to the customers name). Regular usage, wear and tear is not a reason to claim the warranty.

Products subject to constant wear and tear are excluded from the warranty: wooden hockey sticks, composite hockey sticks, hockey sticks, wheels, bearings,...

The warranty covers the following items: sports equipment and props that have the property of a mechanism and components of sports equipment and props that have the property of a mechanism.

The warranty periods are indicated on the warranty statements. Before ordering or returning, the customer can contact the provider, who will provide up-to-date information regarding the warranty conditions for the selected products.

8. Security

The provider uses appropriate technological and organizational means to protect the transfer and storage of personal data.

9. Protection of personal data

The provider undertakes to permanently protect all personal data of the customer. Personal data is protected in accordance with the GDPR regulation.

The provider will use personal data exclusively for the needs of fulfilling the order (sending informative material, offers, invoices) and other absolutely necessary communication. To process orders, we collect the following data: name, surname, address, telephone number, email address.

We pass your data on to delivery services for delivery, in particular we mostly use the GLS and DHL Express services. We only transmit data that is absolutely necessary for delivery.

At the time of purchase, some data is also forwarded to intermediaries that enable payment processing (Stripe for credit card payments, Paypal). Only data that is absolutely necessary for processing payments is transmitted.

Personal data for the purposes of order processing is permanently stored in the provider's order processing accounting system and is accessible only to the provider. At the customer's request, personal data can be deleted at any time.

Under no circumstances will the customer's data be given to unauthorized persons.

The customer himself is also responsible for the protection of personal data by ensuring the security of his username and password.

Data for use in marketing is collected only with the consent of customers and to a limited extent. We collect data for the purpose of sending online news, news promotions. We share this data with the MailerLite platform, through which the aforementioned news is sent. The customer can request to unsubscribe at any time, which also permanently deletes the data collected for these purposes.

10. Communication

To check the data or ensure the accuracy of the delivery, the provider can call the customer on his contact phone number or contact the customer via e-mail.

The provider can also use the customer e-mail to send advertising messages (notifications about various actions, promotions, new products,...), but only if the customer has given explicit permission for this. The customer can unsubscribe from receiving e-news at any time by writing to one from the provider's contact addresses. The provider will expressly respect the customer's wish not to receive advertising messages.

11. Disclaimer

The provider makes every effort to ensure that the information published on its pages is up-to-date and correct. Nevertheless, the characteristics of the items, the delivery time or the price can change so quickly that the provider is unable to correct the information on the web pages. In such a case, the provider will inform the customer about the changes and allow him to withdraw from the order or exchange the ordered item.

Although the provider tries to provide accurate photos of the items sold, all photos should be taken as symbolic. Photos do not guarantee product features.

12. Complaints and Disputes

The provider complies with applicable consumer protection legislation. The provider makes every effort to fulfill its duty to establish an efficient complaint handling system and to designate a person with whom, in case of problems, the customer can contact by phone or e-mail. Complaints are submitted via the e-mail address office@prosports.si or sales@prosports.si. The appeal process is confidential.

Within eight working days, the provider will confirm that it has received the complaint, inform the customer how long it will take to process it and keep him informed throughout the process.

The provider is aware that an essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer not to initiate a dispute before the court. Therefore, the provider makes every effort to resolve any disputes amicably and in the shortest possible time.
